1. Who We Are

These Terms & Conditions (“Terms”) govern your use of services provided by CSSAU Pty Ltd (ABN 61 613 671 499), trading as California Superbike School Australia (“CSSAU”, “we”, “us”, “our”).

CSSAU provides motorcycle rider training and coaching services at various motorsport circuits throughout Australia (“Activities”). These Terms apply to all persons who book, attend, or participate in our Activities (“you”, “your”, “Participant”).

2. Documents That Apply

By making a booking, you agree to be bound by:

  1. These Terms & Conditions;
  2. Our Cancellation & Refund Policy; and
  3. Our Privacy Policy.

Together, these documents form the agreement between you and CSSAU. In the event of any inconsistency regarding cancellation, refund, or credit matters, the Cancellation & Refund Policy prevails over these Terms.

3. Eligibility and Participant Requirements

To participate in CSSAU Activities, you must:

  • Hold a current motorcycle licence (or learner permit with prior written approval from CSSAU);
  • Be at least 18 years of age, or have a parent/legal guardian complete the Minor Participant Waiver;
  • Be physically and mentally fit to ride a motorcycle on a closed circuit;
  • Disclose any medical conditions, injuries, or medications that may affect your ability to participate safely;
  • Have completed all prerequisite levels — levels must be completed sequentially (Level 1, then Level 2, then Level 3, then Level 4); and
  • Comply with all safety, equipment, and conduct requirements set out in these Terms.

Participants under 18 years of age require a parent or legal guardian to complete a Minor Participant Waiver and are subject to additional conditions at CSSAU's discretion.

4. Booking, Payment and Confirmation

Bookings are made through our website and are subject to availability. Your booking is confirmed once full payment has been received and you have received a confirmation email.

All prices are quoted in Australian Dollars (AUD) and are inclusive of GST where applicable. A card processing surcharge of 2% applies to all payments made by credit or debit card. This surcharge reflects the fees charged to us by payment processors and is not a fee imposed by CSSAU.

You may be offered payment by deposit. If so, the remaining balance must be paid by the date specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of your booking and forfeiture of the deposit.

5. Participation Waiver

After payment, we will send you a Participation Waiver to complete electronically. You must complete the Waiver before you can access the track, participate in any Activity, or take possession of a hired bike or equipment.

The Waiver is a separate legal document that sets out the risks associated with the Activities and your acknowledgment and acceptance of those risks. Waivers are valid for 12 months from the date of signing.

If you have not completed your Waiver by event day and are unable or unwilling to complete it on-site, you will not be permitted to participate and the booking will be treated as a no-show under our Cancellation & Refund Policy.

6. Event Changes and Cancellation by CSSAU

CSSAU reserves the right to change the date, time, venue, or format of an event due to circumstances beyond our reasonable control, including but not limited to venue availability, regulatory requirements, or safety concerns.

If we cancel an event, all affected Participants will be offered the choice of a full refund to the original payment method or a credit/transfer to an alternative date at no additional cost.

CSSAU does not cancel events due to weather conditions. Our training drills are effective in all weather, including rain. No refunds or credits will be offered due to weather-related concerns. In the rare event of a venue closure (e.g. flooding, bushfire, government directive), affected Participants will be offered a full refund or reschedule.

7. Cancellations and Refunds

Cancellations by Participants are governed by our Cancellation & Refund Policy, which sets out the tiered refund, credit, and resale arrangements based on when you cancel relative to the event date. That policy is incorporated into these Terms by reference.

In summary, outcomes depend on timing:

  • Within 3 business days of booking: Full refund (goodwill window).
  • Outside the 3-day window and more than 14 days before event: Credit voucher or transfer to another date.
  • Within 14 days of event: Credit voucher plus resale queue.
  • Within 72 hours or no-show: No cash refund; credit only if your spot is resold.

8. Bike Hire and Additional Agreements

CSSAU offers motorcycle and protective equipment hire at selected events. Hire bikes and gear are subject to availability and must be booked in advance through our website.

If you hire a motorcycle, you may be required to sign a separate Bike Hire Agreement setting out the specific terms of hire, including condition reporting, excess liability, and return requirements. That agreement will be provided at the time of hire.

Hire equipment must not be removed from the venue. All hired items must be returned in the same condition as issued, allowing for normal wear. Items not returned, or returned in a damaged condition beyond normal wear, may incur repair or replacement charges at CSSAU's reasonable assessment.

9. Fees, Damage and Charges

If you hire a motorcycle, an excess applies per incident in the event of damage caused by the rider. The excess amount is specified in the Bike Hire Agreement and/or on the booking confirmation. This includes crashes, drops, and mechanical damage caused by rider error.

CSSAU may recover the reasonable cost of repairing or replacing any equipment, property, or facility damaged by a Participant through negligence or failure to follow instructions.

Payment processing fees (card surcharges) are non-recoverable and will not be refunded in the event of a cancellation or refund. See the Cancellation & Refund Policy for details.

10. Safety, Behaviour and Removal

All Participants must wear approved safety equipment at all times while on track, including:

  • Full leather suit (one-piece, or two-piece with 360-degree zip connection);
  • Full-face helmet meeting current Australian Standards (AS/NZS 1698);
  • Leather gloves;
  • Leather motorcycle boots (above ankle); and
  • Back/spine protector (recommended).

Equipment will be inspected on arrival. Riders with non-compliant equipment will not be permitted on track. Hire gear is available if booked in advance.

All Participants must follow coach and marshal instructions, flag signals, and track protocols at all times. CSSAU reserves the right to remove any Participant from an event for unsafe or inappropriate conduct, without refund, at our sole discretion.

11. Liability and Australian Consumer Law

Motorcycle track riding is inherently dangerous. By participating, you acknowledge and accept the risks involved, including the risk of serious injury or death.

To the maximum extent permitted by law, CSSAU, its directors, officers, employees, coaches, contractors, volunteers, and associated venue operators exclude all liability for any loss, damage, injury, or death arising from or in connection with your participation in the Activities.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Where our liability cannot be excluded, it is limited to the maximum extent permitted by law to (at our option): re-supplying the services, or paying the cost of having the services re-supplied.

12. Communications

By making a booking, you consent to receive service communications from CSSAU, including:

  • Booking confirmations, reminders, and changes;
  • Waiver and safety-related notices;
  • Event logistics (venue details, schedule, what to bring); and
  • Post-event follow-ups (feedback requests, level completion).

Service communications are not marketing and cannot be opted out of while you have an active booking.

Separately, CSSAU may send marketing communications (upcoming events, promotions, news) with your consent. You can opt out of marketing communications at any time via your account settings or the unsubscribe link in any marketing email.

13. Privacy

We collect, use, and store your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
